MINUTES OF THE AUGUST 13, 2009 MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF POQUOTT HELD AT 7:00 P.M. AT VILLAGE HALL

Present Mayor Barbara Donovan, Trustees Carol Lane, Christine Vitkun and Kathleen Matthews.  Also present was Village Attorney, Peter Sverd and 10 residents.  Excused was Trustee Sandy Nicoletti.

Opened Public Hearing at 7:00 P.M.

Discussion regarding proposed state mandated Local Law No. 2 of 2009 entitled “Flood Damage Prevention” repealing the prior Flood Damage Prevention Local Law.

Resident Comments:

  1. Resident:  Are the flood maps available for review?  The maps are available at Village Hall.
  2. Resident:  There is a website showing the homes located in a Flood Area.  Roger Flood will supply the village with the web address to be placed on our website.
  3. Resident:  This new statue affects new construction and improvements to existing properties.  Do we know if there are any mandates for existing homes not doing improvements?  Response:  Not at this time.
  4. Resident:  Does FEMA get involved in the flood plain?  Response: No.

A motion was made by C. Lane seconded by K. Matthews to close the public hearing at 7:15 P.M. Aye C. Lane, C. Vitkun, K. Matthews and B. Donovan.  Nay 0.

Meeting called to order at 7:15 P.M.

 

A motion was made by C. Lane seconded by K. Matthews to move the $500.00 tent expense fee for the fish fry from the Mayors account  #A1210.4 to the California Park account  #A.7110.4.  Aye C. Lane, K. Matthews, C. Vitkun and B. Donovan.  Nay 0.
A motion was made by C. Lane seconded by K. Matthews to approve bills totaling $47,140.60, $1,904.05 and $492.00.  Aye C. Lane, K. Matthews, C. Vitkun and B. Donovan.  Nay 0.
A motion was made by C. Lane seconded by K. Matthews to list the project as an unlisted action for SEQRA purposes.  Aye C. Lane, K. Matthews, C. Vitkun and B. Donovan.  Nay 0.
A motion was made by C. Vitkun seconded by C. Lane to adopt Local Law No. 2 of 2009.  Aye C. Vitkun, C. Lane, K. Matthews and B. Donovan.  Nay 0.

Comprehensive Plan:  The committee has prepared a four page survey which will be distributed to village residents.  The committee after receiving the surveys back will hold an informational meeting in the fall or early winter.
California Park Fence:  Our handyman is to install the fence at California Park.  In addition he is to remove the dead plants and small tree around the Bio-Retention area.  K. Matthews to talk to Ken Valadez as to what he recommends to plant in the fall.
Website:  Stafford Associates Computer Specialists Inc. met with members of the Board regarding updating our website.  The cost would be about $5,000.00 to $7,000.00.  We need 2 more quotes and all quotes need to be broken down in detail
P.J. Oil Spill Preparedness:  J. Lane and S. Nicoletti attended the tabletop exercise sponsored by US Coast Guard and Department of Homeland Security on 7/30/09.
Discussion on:

  1. The lead agency would be the US Coast Guard.
  2. What actions would be taken should there be an oil spill
  3. What resources would be needed?
  4. Who would be responsible for cleanup (National Grid).

California Drain Cleaning:  The drain has been cleaned.  The bill needs to reflect emergency cleaning.
Civic Association Fish Fry:  A success, very well organized. Prior to event 210 adults and 64 children under 10 had paid.

New Business

New Village Hall Sign:  Mr. Sign is to give us a quote to replace our Village Hall entrance sign.

Local Law 2 of 2009
Whereas, the Board of Trustees of the Incorporated Village of Poquott, has reviewed the Short Form EAF Parts I, II, and III, with the respect to the proposed Local Law No. 2 of 2009.
A motion was made by C. Lane seconded by K. Matthews to list the project as an unlisted action for SEQRA purposes.  Aye C. Lane, K. Matthews, C. Vitkun and B. Donovan.  Nay 0.
A motion was made by C. Vitkun seconded by C. Lane to adopt Local Law No. 2 of 2009.  Aye C. Vitkun, C. Lane, K. Matthews and B. Donovan.  Nay 0.

The Clerk’s office has received a request for rebate of taxes from a village resident with regards to a grievance they had won with the Town of Brookhaven.  P. Sverd to review letter and recommend a response.

Investment Policy:
WHEREAS the Mayor and the Board of Trustees of the Incorporated Village of Poquott are required to adopt or formulate certain policy and procedures regarding the investment and deposit of Village funds.
Resolved that a certificate of deposit investment approval is made for the Treasurer and Clerk jointly to invest prudently based on rates obtained for terms not more then 90 days with notification to the Finance Officer, Trustees and Mayor of such investment.  After discussion it was determined that the term should be no more than 180 days.  The motion was made by C. Vitkun seconded by C. Lane.  Aye C. Vitkun, C. Lane, K. Matthews and B. Donovan.  Nay 0.
Permits:  No new permits.

Resident Comments:

Resident:  The Village recently placed a garbage can across the street from our home and we are requesting that it be move.  Response:  The Village will look into moving the garbage receptacle from your view.

Correspondence:
A letter from the Setauket Fire Department was received requesting use of the GEM during their 100th Anniversary Celebration.
