MINUTES OF THE MARCH 26, 2009 MEETING OF THE BOARD OF TRUSTEES  OF THE VILLAGE OF POQUOTT HELD AT VILLAGE HALL AT 7:00 P.M.

Present was Mayor Barbara Donovan, Trustees Christine Vitkun, Carol Lane, Carol Castillo and Sandy Nicoletti.  Also present was Village Attorney Peter Sverd and 10 residents.

Minutes
A motion was made by C. Castillo seconded by C. Lane to accept the February 12th, 2009 minutes as corrected.  Aye C. Castillo, C. Lane, C. Vitkun, S. Nicoletti and B. Donovan.  Nay 0.

A motion was made by C. Vitkun seconded by S. Nicoletti to accept the February 26th, 2009 minutes as corrected.  Aye C. Vitkun, S. Nicoletti, C. Castillo and B. Donovan.  Nay 0.  C. Lane abstained as she was not present for the entire 2/26/09 meeting.

Bids-Landscaping Contract

A motion was made by C. Lane seconded by C. Vitkun to accept the bid of Pristine Property Care Ltd for our 2009 landscaping bid at  (8) eight payments of $1,527.23 for a total cost of $12,217.84.  Aye C. Lane, C. Vitkun, C. Castillo, S. Nicoletti and B. Donovan.  Nay 0.

A motion was made by S. Nicoletti seconded by C. Castillo to pay bills totaling $3,279.08.  Aye s. Nicoletti, C. Castillo, C. Vitkun, C. Lane and B. Donovan.  Nay 0.

Local Law Rescinding Accessory Apartment Law
A motion was made by C. Lane seconded by S. Nicoletti to approve Local Law 1 of 2009 repealing Local Law 3 of 2008 Regulating Accessory Apartments within the Village of Poquott.  Aye C. Lane, S. Nicoletti, C. Castillo, C. Vitkun and B. Donovan.  Nay 0.

Treasurer’s Report-John Lane
Reviewed Treasurer’s report.
A motion was made by C. Lane seconded by S. Nicoletti to approve Treasurer’s report.  Aye C. Lane, S. Nicoletti, C. Castillo, C. Vitkun and B. Donovan.  Nay 0.

2009/2010 Budget
Decease street maintenance line #A5110.4 from $50,000.00 to $45,000.00.  Decrease contingency line #A1980.0 from $10,000.00 to $.00.  This will require the Village to allocate $58,147.00 from existing surplus funds to balance the budget.
A motion was made by C. Vitkun seconded by C. Lane to place the proposed budget and public hearing date of 4/23/08 in the local paper.  Aye C. Vitkun, C. Lane, C. Castillo, S. Nicoletti and B. Donovan.  Nay 0.

REPORT OFFICERS, COMMISSIONERS AND COMMITTEES

Carol Lane –Trustee for Environment & Shore Lines
Drains- C. Lane talked to Tom Dixon of Nelson & Pope Engineers and Surveyors regarding the drainage problem at Dyers Court.  The 2 overflow pools do exist and the primary drain is heavily silted.  It is recommended that the drywells be uncovered and cleaned out.  The connecting pipes should also be inspected and cleaned out.  It was also recommended that these drywells be brought to grade with cast iron frames and covers for future maintenance.
C. Lane to contact T. Dixon for names of companies that could give the Village an estimate.
C. Lane to contact Dr. Lederman as to the steps we are taking to prevent flooding on Dyer’s Court.
2009 Stormwater Annual Report.  C. Lane to contact Carrie O’Farrell about this year’s reporting requirements and what date we should schedule our public hearing 5/14/09 or 5/28/09.
Harbor-John Lane- The Harbor Master is in the process of getting the boats ready for the season. 
Public Comments

  1. Resident:  Curbs by Shore Road and Van Brunt Manor Road have been damaged by the snow plows.  Response:  Public Safety will be doing their survey in  April
  2. Resident:  The proposed work at Dyers Court should be in excess of $3,000.00.
  3. Resident:  The plows have also damaged Belgium block on White Pine.  Does the Town of Brookhaven repair the damage?  Response:  It depends on their budget.  If they do not do the repairs our handyman will do the repairs.
  4. Resident:  What about the Fish Fry?  Response:  They need volunteers.  It is going to be mentioned in the upcoming newsletter.  The Village does have the information where the Civic Association can purchase a one day event policy.

Carol Castillo-Trustee for Roads, Roadsides and Parks
Roads- B. Donovan and John Evans drove around the Village on Saturday March 21st and are in the process of preparing a priority list of paving and repairs to Village Streets. Once completed it will be given to our Commissioner L. Mitchell.  A portion of White Pine to Van Brunt Manor Road is #1.
Signs- C. Lane and C. Castillo are in the process of getting prices for new and replacement signs for our Village Beaches and Parks.  The information on the signs would be consistent at all our parks and beaches.   Sign-A-Rama, a company that the Village has worked with in the past is willing to come to the Village to review our existing signage, take the specifications, make recommendations and prepare a proposal.
Grounds Maintenance- Pristine Property Care Ltd has won the contract for 2009.

Public Comments

  1. Resident:  There are broken rails at the triangle at Van Brunt Manor Road and Shore Road.  Response:  We will have our handyman repair the rails.
  2. Resident:  Do you think it is the time to replace our Village signs with our budget restraints?  Response:  We are only getting prices at this time.

Christine Vitkun-Trustee for Finance, Website & Waste Management
Web Site: Our proposed budget will be placed on the website along with our Public Hearing date of 4/23/09.
Waste Management: Vincent Maggio, President of Maggio Sanitation Services, Inc has signed the contract.  We are currently awaiting his performance bond; once received we will release his bid check.

Public Comments:

  1. Resident:  There is a pile of garbage by the receptacle at Walnut Beach that has not been picked up.  Response:  We will forward this information to the commissioner.

Attorney:  No report.
Environmental Action Committee (LIPA)-On 3/12/09 Kevin Law, President and CEO of LIPA presided over a meeting of “stakeholders” (those entities identified being affected by the local power plant re-powering options).  Of the three older plants considered for re-powering the Port Jefferson plant is second, and it is unlikely that they will move on that plant in the next five years.
Three Village Community Trust:  A green and white sign has been erected by the Trust on the Stephen D. Matthews Nature Preserve.  The Trust received a grant in 2008 and has hired Bill Jacobs, Senior Ecologist and Invasive Species Specialist from Energy and Environmental Analysis, Inc. for Earth Day to give a short talk on how to identify the vines and weeds that are choking out trees and native plants.
Earth Day/Poquott Clean-Up Day: Is scheduled for Saturday, April 18th from 10:00 a.m. to 3:00 p.m.  There will be breakfast, lunch, free T-Shirts and an Eco-Walk.
Building Inspector:  No new permits.
Permits/Events: No pending event permits.
Planning Board: No report.
ZBA:  No report.

Other Business
Gallery North Wet Paint Festival:  It will be held in July, it will be held on a Friday and Saturday a specific date has not been selected as of yet.  The artists will be located on Shore Road, in Port Jefferson and with approval on Van Brunt Manor Road.

New Business

  1. A motion was made by S. Nicoletti, seconded by C. Castillo to pay bills totaling $3,279.08.  Aye S. Nicoletti, C. Castillo, C. Vitkun, C. Lane and B. Donovan.  Nay 0.
  2. Roger Flood is in the process a preparing a letter to invite residents to join the special steering committee to review the Master Plan of the Village.
  3. The Village newsletter should be mailed out shortly.
  4. Jim McNamara and Ken Brady are looking to display the photos of the Village of Poquott from the art exhibition that was recently held in Port Jefferson.  They are looking to display these photos the weekend of July 4, 2009 at Village Hall.  This exhibition was sponsored by Mary Sabatelli, a resident of Poquott.

Public Comments

  1. Resident:  Very pleased that the Board was able reduce this year’s tax bill.  Where did the surplus come from?  Response: Sometimes we have been able to obtain grants for budgeted expenditures, spend less then what we have budgeted for and mortgage tax revenue has been higher in the past than anticipated. 
  2. Resident:  I feel the Board has received a bad rap this year and I want them to know not everyone feels that way.  Response:  Thank you it is greatly appreciated.
