MINUTES OF THE FEBRUARY 12, 2009 MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF POQUOTT HELD AT VILLAGE HALL AT 7:00 P.M.

Present was Mayor Barbara Donovan, Trustees Sandy Nicoletti, Christine Vitkun, Carol Lane and Carol Castillo.  Also present was Village Attorney Peter Sverd and 15 residents.

PUBLIC HEARING:  For Local Law 1 of 2009 repealing Local Law 3 of 2008 regulating accessory apartments.

  1. Resident: Why is the law being repealed?  Response:  There were procedural errors.  A SEQRA was not performed.
  2. Resident:  Why not correct the error instead of repealing the law?  We are not allowed to make the corrections.  We must repeal the law.  There is a process we must follow.
  3. Resident:  Are there numerous apartments in the Village?  Response:  There are some.
  4. Resident: Does the Village seek out apartments?  Response:  No.

B. Donovan:  Our Master Plan needs to be updated.  No new laws that affect zoning can be enacted until the Master Plan of the Village is reviewed.
A motion was made by C. Lane seconded by C. Castillo to close the Public Hearing at 7:10 P.M.
 
Resolution
Be it Resolved  that the Board of Trustees of the Village of Poquott wishes to establish a Special Board consisting of a member from the Planning Board, A Trustee and at least 3 residents with one representative from zone A, B, and C to review the Master Plan of the Village.  A motion was made by C. Lane seconded by S. Nicoletti to accept this Resolution.  Aye C. Lane, S. Nicoletti, C. Castillo, C. Vitkun and B. Donovan.  Nay 0.

A Motion was made by C. Lane seconded by C. Castillo to accept the bid from Maggio Sanitation Service, Inc. for the 2009-2012 with a contract total of $312,813.60.  Aye C. Lane, C. Castillo, S. Nicoletti, C. Vitkun and B. Donovan.  Nay 0.

A motion was made by C. Castillo seconded by C. Vitkun to pay the bills totaling $68.93, $149.99, $506.06 and $14,197.60.  Aye C. Castillo, C. Vitkun, S. Nicoletti, C. Lane and B. Donovan.  Nay 0.

Poquott Fish Fry:  Henry Nietzchmann questioned whether the Village can have a Fish Fry?  It is an opportunity for the Villagers to meet their neighbors.  Response:  The Village cannot host the event as we are not allowed to charge a fee for an event.  The Village can and in the past has supplied the tent for this event.  This event has always been run by the Civic Association.

2009/2010-Budget-The budget must be completed by the last meeting in March (3/26) to have the information available to run in the local paper prior to the Public Hearing on 4/23/09.

Comprehensive Master Plan-Resolution to establish a Special Board

The last time our Comprehensive Plan was reviewed was in the late 1970’s.  Before any legislation regarding zoning can be considered it is best that this plan is reviewed.  Cathy Greene from the A zone has volunteered to be on this Special Board.

Other Business
Thomas Maus from Northville Industries Corp. met with the B. Donovan, C. Lane and several representatives from the Setauket Fire Department.  Mr. Maus informed the attendees that Northville will be receiving fuel shipments by barge and tankers.  The Army Corp of Engineers has done studies and the harbor depth is sufficient for tankers.  The tankers entering the harbor will be 600 feet long and 100 feet wide and are only able to come into the harbor during high tide.  They will be escorted by two tugs and they will take approximately a day and a half to unload their cargo.  The representatives from the Fire Department were concerned about the safety of the docking facility.  Mr. Maus informed the attendees that the facility has been continually updated and they are welcome to come and observe their facility.

New Business
A motion was made by C. Lane seconded by C. Castillo to accept the bid from  Maggio Sanitation Service, Inc.  for the 2009-2012 with a contract total of $312,813.60.  Aye C. Lane, C. Castillo, S. Nicoletti, C. Vitkun and B. Donovan.  Nay 0.

A motion was made by C. Castillo seconded by C. Vitkun to pay the bills totaling $68.93, $149.99, $506.06 and $14,197.60.  Aye C. Castillo, C. Vitkun, S. Nicoletti, C. Lane and B. Donovan. Nay 0.

It was suggested that the minutes be approved at the first meeting of the month or possibly approved at each meeting so the website can be updated twice a month.  Need to find out what the cost would be for updating the website twice a month.

A resident stated that some of the duck hunters are leaving their kill on the beaches.  The resident was informed to call the DEC when this occurs.  The hunters are responsible to take the animals they have shot and not leave them on the beach.

Permits: No new requests

Correspondence:  The correspondence from Peter Stubberfield will not be read into the minutes.  However, a response will be prepared and sent to him.

Executive Session:  A motion was made by C. Lane at 9:10 P.M. to go to executive session to discuss a potential litigation.  The Board returned from executive session at 9:25 P.M.
 
The clerk presented the proposal from Suffolk County National Bank.

Motion to adjourn was made by S. Nicoletti at 9:30 P.M.
