MINUTES OF THE JANUARY 22, 2009 MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF POQUOTT HELD AT VILLAGE HALL AT 7:00 P.M.

Present Mayor Barbara Donovan, Trustees Carol Lane, Carol Castillo and Sandy Nicoletti.  Village Attorney, Peter Sverd, attended the meeting thru speaker phone.  There were five residents in attendance.  Trustee Christine Vitkun was excused.

A motion was made by C. Castillo seconded by C. Lane to accept the minutes of December 18, 2008 with corrections.  Aye C. Castillo, C. Lane, S. Nicoletti and B. Donovan.  Nay 0.

A motion was made to accept the Treasurer’s report as written was made by S. Nicoletti seconded by C. Castillo.  Aye S. Nicoletti, C. Castillo, C. Lane and B. Donovan.  Nay 0.

A motion was made by S. Nicoletti seconded by C. Castillo to adopt the RESOLUTION AUTHORIZING THE ADOPTION OF THE SUFFOLK COUNTY MULTI-JURISDICTIONAL MULTI-HAZARD MITIGATION PLAN.  Aye S. Nicoletti, C. Castillo, C. Lane and B. Donovan.  Nay 0.

A motion was made by S. Nicoletti seconded by C. Castillo to adopt the RESOLUTION TO HOLD A PUBLIC HEARING AT VILLAGE HALL, 45 BIRCHWOOD AVENUE, SETAUKET, NEW YORK ON FEBRUARY 12, 2009 AT 7:00 P.M. TO REPEAL LOCAL LAW NO. 3 OF 2008 ENTITLED “ACCESSORY APARTMENT.”  Aye S. Nicoletti, C. Castillo, C. Lane and B. Donovan.  Nay 0.

A motion was made by C. Lane, seconded by C. Castillo to hire the firm of Cahn & Cahn to review the title documents and the maps of Van Brunt Manor Beach for a cost of not more than $2,000.00, with notification to the Village Board when the cost has reached the level of $750.00, $1,000.00 and $1,500 to obtain authorization to continue their research.  Aye C. Lane, C. Castillo, S. Nicoletti and B. Donovan.  Nay 0.

A motion was made by C. Castillo seconded by C. Lane to pay the bills totaling $21,556.87.  Aye C. Castillo, C. Lane, S. Nicoletti and B. Donovan.  Nay 0.

2009/2010 Budget: Reviewed current budget figures.  It was suggested that Treasurer, John Lane, Mayor, Barbara Donovan, Trustee Christine Vitkun and Village Clerk, Eileen Harvey have a work session regarding the budget.

REPORTS OF OFFICERS, COMMISSIONERS AND COMMITTEES

Carol Lane-Trustee for Environment & Shore Lines
Drains:  Richard Parrish is requesting $17,000.00 for the drains budget.   He also suggests sweeping of the streets occur more frequently.  Our engineers have submitted their fee ($500.00) to look at the drain on Dyers Court and prepare a proposal for the work.  It was recommended that they also look at the problem on Indian Valley, White Pine and Singingwood.  C. Lane to call the engineers to possibly include reviewing these three other problem areas in this fee.
2009 Stormwater Annual Report:  DEC has not produced the 2009 template as of this date.
Harbor/Mooring:  Nothing new.
Public Comments:

  1. Resident: Drainage problems will increase as the drains age. With age, sediment builds up in the walls and they do not drain as well.
  2. Resident: Are there State Funds available for rebuilding the drains?  Response:  Yes there are funds available and we always try to obtain outside funding.

Carol Castillo-Trustee for Roads, Roadsides and Parks
Roads: Lois Mitchell is requesting $50,000.00 to $75,000.00 for the roads budget.
Public Comments:

  1. Resident:  When the stop sign is replaced at White Pine Lane and Van Brunt Manor Road it needs to be lowered.
  2. Resident:  The sign at Silver Beech Court and Indian Valley Road should also be lowered.

Christine Vitkun (Excused)-Trustee for Finance, Website & Waste Management
Website:  Agenda is on the Website.  The Stormwater Management report # 5 is available to be placed on the website.  Clerk to verify if prior years can be removed.
Waste Management:  Bids for the new fiscal year will be opened at the February 12th, 2009 meeting.  At present three bid packages have been picked up.
Public Comments:

  1. Resident:  Can the garbage company put the tops of the cans back on the resident’s property?  Response:  Any complaints should go to Linda Newfield who will discuss the issue with the garbage company.
  2. Resident: How often is the Village calendar placed on the website? Response: Once a year after the organizational meeting in July.
  3. Resident:  The Planning Board meetings on the calendar are incorrect.  Response: Call or e-mail C. Vitkun with the correct schedule.
  4. Resident:  Does the garbage company pickup the discarded Christmas trees?  Response:  They will pick up the trees on Thursday.
  5. Resident:  The small garbage truck covers our street, will they still take the trees?  Response:  They are to let the driver of the large truck know about the trees.  Any problems call Linda Newfield.

Sandy Nicoletti-Trustee for Public Safety &
Van Brunt Manor Park and Beach
Public Safety:  Reviewed monthly report from Public Safety.  Public Safety is currently driving up and down the driveways on their house check list, so the house does not look vacant.
Special Event Permits:  None at this time.  There was one inquiry for an event in May.
Public Comments:  None

Attorney:  We are coming to the end of our investigation of ownership of Van Brunt Manor Beach.  At our last meeting I recommended the Board hire an attorney who works closely with a title company and is familiar with title research.  I would recommend hiring Cahn & Cahn from Melville.  Richard Cahn will charge $250.00 an hour and Daniel Cahn, his son, charges $200.00 an hour. The firm will keep the Board informed when the cost has reach $750.00, 1000.00, $1500.00 to get authorization to continue their research.

National Grid and LIPA Funds:  It may be time that we send a letter letting them know we are considering litigation.
Environmental Action Committee (LIPA):  There is a meeting next Wednesday January 28, 2009 at Kathy Matthews’s house.  PEAC is trying to get Kevin Law from LIPA to attend their next meeting.
Building Inspector: Nothing new.
Planning Board:  Roger Flood, chair of the Planning Board, reviewed his report that was previously submitted to B. Donovan regarding his Board’s discussion about the pyramid law as well as recommendation for zoning changes.  The Planning Board also discussed working on a Comprehensive Master Plan.
It was recommended that a committee of residents and Planning Board members work on the Master Plan.
The Planning Board is looking for a budget of $500.00.
It was recommended that the Planning Board hold off working on the Pyramid Law and the Tree Clearing Law until review of the master plan has been completed.
ZBA:  No requests pending.
Other Business:
A motion was made by C. Castillo seconded by C. Lane to pay the bills totaling $21,556.87.  Aye C. Castillo, C. Lane, S. Nicoletti and B. Donovan.  Nay 0.
New Business:
Verizon has requested a street opening permit. Verizon was informed that we need the $75.00 fee and $35,000.00 bond before permit will be approved.
Correspondence:

  1. New York State Archives Training is available.
  2. A meeting for the Vision for a Green Route 347 will be held 1/29/09 at the State Office Building in Hauppauge.  Information regarding this is to be forwarded to C. Vitkun to be placed on our website.
  3. Information regarding LI 2035, Future of L.I. was received.
  4. NYCOM conference is February 22-24
  5. Peter Baynes of NYCOM forwarded information on the Federal Stimulus Package.

Public Comments:

  1. Resident: What is the construction in progress on page #9 of the auditors report?  Response:  We believe it is California Park project.  John Lane to verify with the auditors.
  2. Resident:  Regarding the Brookhaven Mitigation agreement do we share in the grant funds?  Response: Yes.
  3. Resident:  Do any of the Van Brunt Manor Beach maps show before the dredging?  Response: Yes, on a map dated February 1931 the year of the Village’s incorporation.
