MINUTES OF THE AUGUST 23, 2007 MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF POQUOTT HELD AT VILLAGE HALL AT 7:00 P.M.
Present Mayor Barbara Donovan, Trustees, Carol Lane, Sandra Nicoletti, Christine Vitkun, absentTrustee Carol Castillo also present Village Attorney Peter Sverd and 9 residents.

Minutes of July 2, 2007 Organization meeting accepted as written on a motion by C. Lane, seconded by C. Vitkun, Aye, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.
Minutes of the July 12, 2007 business meeting were accepted as corrected on a motion by S. Nicoletti, seconded by C. Lane, Aye, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.
Minutes of the July 26, 2007 general meeting were accepted as corrected on a motion by C. Lane, seconded by S. Nicoletti, Aye, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.

REPORTS OF OFFICERS, COMMISSIONERS AND COMMITTEES
JOHN LANE – TREASURER-the Treasures report was accepted as presented on a motion by S. Nicoletti, seconded by C. Vitkun, Aye, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.
After discussion the Board approved an increase in category A3620.4 of 3% as a cost of living increase retroactive to January 1, 2007.
CAROL CASTILLO- TRUSTEE FOR ROADS, ROADSIDES AND BEACHES

  1. ROADS- the Town of Brookhaven has been contacted re: paving and referred the Roads Commissioner to Rosemar Paving Contractors who holds the County contract for tonnage that covers our project. A call to Rosemar will be made to ask for their price to pave Birchwood Ave. etc. There was discussion re: pothole on Highview Ave.

CHRISTINE VITKUN- TRUSTEE FOR FINANCE, VILLAGE HALL, & WASTE MANAGEMENT

  1. GENERAL CODE—all parts of the project should be sent to the Village by months end.
  2. WASTE MANAGEMENT—a letter to the carter and notices to the villagers about keeping the mailboxes clear should end the problem with the postal service.

CAROL LANE—TRUSTEE FOR ENVIRONMENT & SHORE LINES

  1. DRAINS-- report from R. Parrish reviewed by the Board.
  2. HARBOR & MOORINGS- J. Lane reported that the five-mile-per-hour buoys would not be installed until next season.

SANDRA NICOLETTI- TRUSTEE FOR PUBLIC SAFETY & VANBRUNT MANOR BEACH

  1. PUBLIC SAFETY- the sign on VanBrunt Beach was spray painted again.
  2. SPECIAL PERMITS- Betts party scheduled for 9/9/07

ATTORNEY

  1. Zoning Law and Commercial Vehicle laws still under review.
  2. Verizon Franchise Agreement- amendments for property restoration added, indemnification section was strengthened, PEG – Village has no interest at this time, Franchise fees increased, five year buildout. Franchise agreement can now be adopted by the Village.
  3. LIPA—bid for the air monitoring will be required due to the dollar amount of the project. Discussion on whether to drop the monitoring or not.
  4. Bathing Assoc.—Attorney asked if there where deeded rights to beach to villagers? Answer no deeded rights unless beachfront ownership.

CALIFORNIA PARK PROJECT—discussions held with Peter Scully of the D.E.C. to expedite the permits.
VILLAGE HALL- JUSTICE COURT – grant being put together for Justice Court furnishings and security measures. Quotes on surveillance equipment are coming in at $10,000.00 per installation for 24/7 coverage
PLANNING BOARD—next meeting 9/13/2007
OTHER BUSINESS
1)The Board increased the salary of the Building Inspector retroactive to Jan. 1, 2007 by a 3% COLA on a motion by C. Lane, seconded by S. Nicoletti, Aye, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.
2) The Board on a motion by C. Vitkun, seconded by C. Lane adopted the NYS Uniform Building Code in its entirety as the Building Code of the Village of Poquott. Aye, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.
3) The Board on a motion by C. Lane, seconded by S. Nicoletti adopted a building cost for accessory buildings of $25.00 per square foot. Aye, , C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.
4) The Board on a motion by C. Lane, seconded by C. Vitkun adopted the following late filing fees :

A) Failure to obtain a Certificate of Occupancy on permitted work within Eighteen (18) Months will result in a $ 250.00 late filing fee 
B) Failure to obtain a building permit prior to construction will result in a $250.00 late filing fee.

5) The Clerk requested permission to adjust the tax bill for # 11 Maybeck Drive to reflect the reduced value based on the Town of Brookhaven reassessment. Permission granted.
6) The question of the address confusion for # 17 Singingwood Lane and #17 White Pine Lane is still being worked on with the homeowners involved, solution is expected soon.
