MINUTES OF THE AUGUST 9, 2007 PUBLIC HEARINGS AND MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF POQUOTT HELD AT 7:00 P.M. AT VILLAGE HALL.
Present Mayor Barbara Donovan, Trustees Carol Castillo, Carol Lane, Sandra Nicoletti, Christine Vitkun, Village Attorney Peter Sverd and 19 residents.

PUBLIC HEARING – LOCAL LAW 1 0F 2007
The Local Law 1- 2007 hearing held on February 8, 2007 resulted in some changes to wording re: abandoned vehicles that have been addressed in this revision.
PUBLIC COMMENT—none
The Public Hearing was closed on a motion by C. Castillo

OTHER BUSINESS

  1. CALIFORNIA PARK PROJECT - A motion to authorize the Mayor to sign the contract with D.F. Stone for the California Park project was made by C. Vitkun, seconded by S. Nicoletti- Aye C. Castillo, C. Lane, S. Nicoletti, C. Vitkun, Nay 0.
  2. BEACH PERMIT- discussion on whether or not a lease to a bathing association by the Village would be legal. Further research will be needed to settle this question.
  3. LIPA/KEYSPAN- a copy of the easement survey is needed for review. The air monitoring study bid package is almost complete.

NEW BUSINESS

  1. ROADS—a survey of Village roads indicates that the order of repair/repaving should be Birchwood Ave., Walnut Ave., Maple Ave. It appears that damage to both Maple Ave. and Chestnut Ave. was caused by construction and the bond company should be involved in the repair cost.
  2. UTILITY PATCHES—during the survey it was noted that several utility patches were defective and need to be corrected. The Clerk was asked to check for bonds for the utilities and contact the bond companies.

PUBLIC HEARING—VERIZON FRANCHISE
The purpose of this hearing is to determine if the Village will enter into a franchise agreement with Verizon to provide FIOS service to Poquott.

  1. Aldo Bianci- Verizon—agreement would provide Villagers with competition with existing cable provider.
  2. Joan Ellison—Verizon—FIOS would bring technology to every premises. Allow for competition in pricing and programming.
  3. Joan Gilroy—Cablevision—welcomes competition, however sees protection for the Village lacking in the agreement. The Board should review the agreements signed by Islip, Huntington and Smithtown.
  4. James Goren—Cablevision—agreement needs to be reworked to protect the Village and level the playing field with existing competition.
  5. RESIDENT—the Board should consider the comments of both Verizon and Cablevision. Competition is good, but Verizon needs to prove itself.
  6. RESIDENT—competition is good; however, the Village should make sure it gets a good deal.
  7. RESIDENT—competition is good; however, paragraph 2.9 Restoration of Property (municipal or residential) needs to be rewritten. Also the resident has issues with the rollout dates and the performance bonds.
  8. C. Vitkun—will you be dealing only with overhead lines now, not underground? Verizon answer—all residents will be able to connect in time. Approx. 70% should be able to connect by year end.
  9.  RESIDENT—what percentage of homes have overhead lines? Ans. -  approx. 2/3 of residences are connected by overhead lines and 1/3 have underground lines.
  10. RESIDENT—fiber optic is the wave of the future. When will the deal be signed and how good is it for the Village.

The hearing was closed on a motion by C. Lane.

NEW BUSINESS

  1. CAMERAS—equipment is not the expensive part of the question. The monitoring cost per month is the true cost. Discussion followed re: how many cameras would be needed and where versus the cost of installation and repairs/replacements.
  2. A motion to adopt Local Law 1- 2007 was made by C. Castillo, seconded by C. Lane. Aye C. Castillo, C. Lane, S. Nicoletti, C. Vitkun, B. Donovan, Nay 0.

PERMITS
16 Walnut Ave. has been approved. 6 Singingwood Lane has been approved and is pending fee payment. 4 Indian Valley has a stop work order issued and the homeowner is in the process of complying with the Building Inspectors list of requirements to lift the stop work order.
ATTORNEY
A letter will be prepared and sent to the residents of Maybeck Drive involved in the discussion on the drain problem.
CORRESPONDENCE

  1. 2010 census – class dates for census instruction.
  2. Matthews Preserve re: survey of preserve and species.
  3. Amendment to Zoning Laws—tabled until Oct. 2007 meetings.

PUBLIC COMMENTS

  1. J. Gilroy—Cablevision has contracts with camera companies. She will forward a list to the Village.
  2. Resident—Board should make up the vehicle maintenance schedule, not the mechanic.
  3. Resident—roadside cutting on VanBrunt Manor Road is appreciated.
  4. Resident—the retaining wall in the subdivision should not be eliminated from the plan. Ans.- that issue should be raised at the planning Board meeting not the Village Board meeting.
  5. Resident—construction on 25A oversteps existing building lines.
  6. Resident—cell phone reception is spotty within the Village. Will the Verizon deal help? Ans. no.
  7. Resident—camera issue also needs discussion on battery replacement, height of installation, visibility and exposure.
  8. Resident—install dummy cameras instead.
  9. Resident—when will the Matthews Preserve change hands? Ans. No change will be made to ownership, only change will be in stewardship of the property.
  10. Resident—when will the “No Wake” buoys be installed? Ans. - as soon as the price of installation is obtained.
  11. Resident—all three beaches should be considered in the beach permit process. Resp. -  cost factor and space requirements must be considered in the process.
